The Citizenship Act of 2021 was introduced on February 18th. The Biden Administration formally introduced the new immigration bill this bill included Provisions that would impact all aspects of what the administration feels is a broken immigration system. The first day of the new Administration President Biden stated that this bill improves the chances for Humanity in American values in our immigration system. The new immigration Bill plans to undo many of the Trump administration’s executive actions that cause delays and limitations on immigration.

1. The new US immigration citizenship act includes many provisions number one being section 3101.
   Section 3101 which would recapture immigrant visas that were lost to a bureaucratic state. It would allow the reclassification of spouses and minor children of lawful permanent residents as immediate relatives this means that immigrant Visa numbers would be immediately available to complete the Green Card sponsorship process.
2. Section 3103 would raise the per country Green Card limit cap for family and employment-based immigrants from currently which is 7% limitation to 20% of the world.
3. Section 3104 would promote family Unity. Section 3404 would increase immigrant visas for other workers which wouldn’t freeze immigrant visas and employment-based third preference category of other 10,000 to 40000 where the world would require less than 2 years experience.
4. Section 3405 which would authorize the Secretary of Homeland in consultation with the Department of Labor to reduce formation of EBT 2 or eb-3 immigrants during times of high employment in particular Geographic areas or labor market sectors.
5. Section 3407 This section would allocate H-1B cap Visa numbers prioritization based on the wages offered to the employee. It would also allow the Secretary of Homeland Security in labor to expand this To None immigrant worker categories when doing so it seemed appropriate.
6. Section 3409 provides expansion of the benefits of the work authorization for H4 Visa holders which includes both spouses and children the car regulations only currently allow for h-4 spouse to hold such work authorization section 3410 would provide additional stiction of non-immigrant Visa status and 1 year increments to a person that’s in F1 H-1B L&O Visa status if they’re immigrant Visa petitions or labor certification have been pending for more than one year. This would expand the current law to allow that H-1B visa status persons are eligible to expense then there’s got to be some time limits for certain milestones in the Green Card process.
7. The US citizenship act also proposes to change the term alien to non-citizen to better align with the president’s values on vision and vision on immigration moving forward there are also additional sessions to reevaluate those subject to HR Provisions in expanding the equality treatment of lgbtq + Partnerships.

Democrats have a long battle in order to get this passed through the regular legislative process and the White House has not commented on whether they would try to pass the bill to the reconciliation process. Although there is no exact determining date of when this new legislation will pass, the fact that the president has immigration on his mind is a good thing for America and moving forward for immigration immigrants in the future.
